Kamila Grabska’s substantial insurance claim, rooted in alleged disabling injuries, has been rejected after evidence surfaced of her vigorous participation and triumph in a Christmas tree throwing contest. Grabska, 36, had asserted enduring neck and back pain following a 2017 crash, impairing her ability to work and carry out daily tasks, as per reports from SWNS, the Irish Independent, The Guardian, and NBC News.
However, during a recent court hearing, a striking photo emerged, depicting Grabska energetically tossing a Christmas tree during a competition she won in January 2018, casting doubt on the severity of her injuries. Judge Carmel Stewart, presiding over the case, emphasized the significance of this image, stating, “It is a very large, natural Christmas tree and it is being thrown by her in a very agile movement.” This visual evidence played a pivotal role in the dismissal of Grabska’s claim.
In response, Grabska argued that she still experienced discomfort during the tree throwing event and emphasized her subsequent job resignation and disability collection as evidence of her ongoing suffering. She asserted, “I was simply trying to live a normal life.” Despite her defense, the judge remained unconvinced, stating, “I’m afraid I cannot but conclude the claims were entirely exaggerated.”
The case, concluded last week according to Ireland’s High Court website, underscores the importance of scrutinizing the legitimacy of insurance claims. RSA insurance expressed satisfaction with the verdict, with a spokesperson stating, “We are very pleased with the outcome of this case and it sends out a clear message that we will robustly challenge any attempt to pursue claims that are not genuine.”
