UAE: Woman awarded AED 20,000 after doctor’s error leads to ongoing hand pain

Abu Dhabi Family Court for Civil and Administrative Cases has ordered a doctor to pay AED 20,000 in compensation to a woman who suffered ongoing pain in her right hand following a surgical error.

According to a Gulf Today report, the woman initially sought treatment from the doctor and underwent minor surgery. However, after being discharged from the hospital the next day, she continued experiencing severe pain that disrupted her sleep and ability to work for several days. Despite returning to the same doctor and being prescribed painkillers, her condition did not improve, and her insurance eventually stopped covering the medication costs.

She later filed a complaint with the Department of Health, which confirmed that a minor medical error occurred during the procedure. It was found that the doctor, who was not specialized in the required field, caused her a 2% permanent disability.

Seeking higher compensation, the woman filed a lawsuit against the medical center and the doctor, claiming she spent over AED 100,000 on treatment and requested damages for physical, psychological, and moral harm.

After reviewing the case, the court awarded her AED 20,000 for moral damages but rejected the rest of her claims due to a lack of evidence supporting additional physical harm or proof of medical expenses.
