Sharjah to prioritize investigation over jail time for debtors

Sharjah has announced a new policy regarding debtors, prioritizing investigation and reconciliation over immediate imprisonment.

Under the directive of Sheikh Dr Sultan bin Muhammad Al Qasimi, the Sharjah Judicial Council will now require creditors to demonstrate a debtor’s ability to pay, or prove they are concealing assets or refusing payment without valid cause, before imprisonment is considered.

This move aims to protect human dignity and ensure justice. The council has also instructed the Public Prosecution to collaborate with family and social affairs agencies to promote amicable resolutions and reconciliation in family disputes before legal action.

The Judicial Council, chaired by Sheikh Sultan bin Ahmed bin Sultan Al Qasimi, discussed various other topics, including the transition to local staff within the judicial system.
