Guy Mukendi, 39, from Brixton in south London, has been sentenced to over four years in prison for removing a condom during sex without his partner’s consent, an act known as “stealthing.” The offence is classified as rape under English law.
The woman had consented to sex on the condition that a condom was used. After realizing what had happened, she contacted the police in May 2023. Forensic evidence and text messages, in which Mukendi admitted to the act because he hadn’t had sex in a long time, were presented in court.
The Inner London Crown Court found Mukendi guilty of rape on April 2, 2024, and he was sentenced on Thursday to four years and three months in prison. The victim has been granted a five-year restraining order against Mukendi.
A Met Police spokesperson emphasized the importance of reporting such crimes, stating, “The victim did the right thing to call the police straight away, and her bravery should not be overshadowed.” They also reiterated that non-consensual condom removal is a form of rape and encouraged other victims to report it to the police to capture evidential opportunities.
According to the Sexual Offences Act 2003, conditional consent is applicable in such cases, confirming that the deception about the nature of sex qualifies as rape under English and Welsh law.
