Davao City man arrested for threatening neighbor with replica gun over loud music

A man was arrested for threatening his neighbor with a “gun” in Davao City early Thursday morning.

The police responded to a complaint from residents, alleging that 49-year-old property evaluator “Ariel” brandished a replica gun at his neighbor, 30-year-old Kenneth Celis. According to the Davao City Police, Ariel became upset over the loud music Celis was playing late at night.

Ariel used a replica of a Pietro Beretta gun, which was confiscated by the police.

The police will charge Ariel with violating Article 5 Section 35, which pertains to the use of imitation firearms, under Republic Act 10591 or the Comprehensive Law on Firearms and Ammunition.

According to the Davao City Police Office (DCPO), Ariel should have contacted them to resolve his complaint. The city has an Anti-Nuisance Ordinance prohibiting disturbing noises after 10 PM, and the suspect could have filed a complaint if there were witnesses to the violation.
