The UAE Government has issued a new Federal Law focusing on mental health. This groundbreaking legislation introduces stringent penalties for those who violate its regulations, including imprisonment and fines ranging from Dh50,000 to Dh200,000.
The law is a leap forward in aligning with contemporary practices in mental health care, ensuring the protection and provision of top-tier care for psychiatric patients. It aims to regulate interactions between patients and healthcare providers and mandates adherence to the highest standards of care.
A key aspect of the law is its emphasis on preserving the dignity and rights of psychiatric patients. It focuses on reducing the impact of mental conditions on individuals, their families, and society, while promoting social integration. The law encompasses all aspects of mental health, including patients, healthcare facilities, and other institutions involved in psychiatric care, even those in free zones.
A notable provision is the prohibition of mental health services without proper authorization, ensuring that care is regulated and standardized. Patients’ rights are at the forefront, with guarantees for receiving clear information about their rights, the ability to lodge complaints, and the assurance of receiving necessary care while retaining civil rights.
The law also safeguards patients’ employment rights, preventing discrimination and exploitation. It maintains the confidentiality of patient information and the security of their personal belongings in care facilities.
Additionally, the legislation outlines comprehensive post-discharge care plans, access to medical insurance, education, recreational activities, and advocacy representation. It ensures patients receive appropriate psychotherapy and medications, with full disclosure of treatment plans, risks, benefits, and emergency protocols.
Special provisions are made for minor psychiatric patients, including age-appropriate health guarantees, rights to education, and separate accommodation from adults. Monitoring committees will be established in each emirate and within each health facility to enforce patient rights and address complaints.
The law also defines admission types to mental health facilities and sets regulations for various scenarios like voluntary admissions for substance abuse treatment, patient escapes, or deaths within the facility. It delineates cases of psychological restraint, patient transfer, and compulsory outpatient treatment.
